Terms of Service

These terms govern your use of ownthead.com ("the Site"), operated by OWNTHEAD ("we", "us"). By using the Site you accept them.

1. What OWNTHEAD is

OWNTHEAD sells advertising space on crowd-funded outdoor advertising campaigns. Each campaign targets one physical billboard in one city. Visitors buy defined rectangles of that billboard's surface, upload artwork, and — if the campaign reaches its published minimum — that artwork is printed and displayed physically.

We are an advertising seller. We are not a crowdfunding platform, a charity, an investment scheme, or a marketplace between third parties. You buy advertising inventory from us directly.

2. Who may buy

You must be at least 18 and able to enter a binding contract. If you buy on behalf of a company, you confirm you are authorised to do so.

3. Buying

Prices are calculated server-side from position, size, and how much of the billboard is already sold. The price shown before payment is the price charged. Selecting territory creates a temporary reservation; if it expires before payment, the territory returns to sale and no charge is made.

A purchase is complete only when our payment provider confirms it to us directly. A browser returning to a success page is not, by itself, proof of purchase.

4. Your artwork

Everything you submit is reviewed by a person before it appears publicly. See the Creative Guidelines. We may reject artwork, and the owner of the physical billboard may also reject it. Rejected sponsors are refunded in full under the Refund Policy.

5. What we do not promise

We do not guarantee any audience, number of views, impressions, clicks, or commercial result. Where we publish audience estimates, we name the source and its methodology; estimates are not guarantees.

We do not promise a specific street, address, or billboard until a media booking is contractually secured, at which point we publish it.

6. Availability

The Site is provided as-is. We may change, suspend, or discontinue parts of it. Where a change affects sponsorships already paid for, the Sponsorship Terms and Refund Policy govern.

7. Liability

Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you in connection with a campaign is limited to the amount you paid us for that campaign.

8. Our intellectual property

The Site is ours. The source code, the interface, the artwork editor, the pricing engine, the brand marks, the photographs we publish, and every word of copy on ownthead.com are protected by copyright and remain our property. Buying advertising territory gives you a rectangle on a billboard; it gives you no rights in the platform that sold it to you.

You may not copy, scrape, mirror, reverse-engineer, or reproduce the Site or any substantial part of it, and you may not use our name or marks without written permission.

9. Governing law

These terms are governed by the laws of Italy, and the courts of Italy have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.
